Please read carefully! Approved Operator has read this agreement and understands and agrees to the following:

Approved Operator agrees to pay Laughlin River Jet Ski Rentals (“LRJSR”) for the charter of said vessel at the posted rate. Reservation deposits are non-refundable. *
Approved operators and participants agree to read carefully the Rules, Regulations and Instructions, PWC Orientation Checklist, and Warnings, Risks and Release, and must initial and sign where indicated. *
It is the Approved operators’ responsibility to inspect and note any damages or missing equipment to the Watercraft BEFORE BOARDING. *
Approved operator may take photographs before and after rental. *
If any damage is chargeable to the approved operator, the approved operator may request electronic copies of LRJSR’s pre-rental and post-rental photographs of the Watercraft depicting the damages allegedly caused by the approved operator. *
The Watercraft must be returned in the same condition as received and as noted in the pre- boarding inspection. *
Each Watercraft will be inspected by both parties before and after each rental to determine the condition of the Watercraft. *
All riders and passengers must wear proper life jackets at all times while on the Watercraft, maintain a lookout in ALL directions at ALL times. *
All persons & operators renting equipment must have a valid driver’s license and be 18 years of age. *
Towing of tubes, skiers, Watercraft or any person or object is NOT PERMITTED at any time. *
OPERATING THE WATERCRAFT UNDER THE INFLUENCE OF ALCOHOL OR DRUGS IS NOT PERMITTED AT ANY TIME. *
Boundaries are from Davis dam (2 miles north) to the Avi Casino (18 miles south). If LRJSR has to service outside of these boundaries for ANY REASON YOU WILL BE CHARGED A MINIMUM OF $300.00. *
Refuel during rental is 10 gallon minimum at six dollars ($6.00) per gallon. *
If you run out of gas within the boundaries and LRJSR has to service you, you will be charged a minimum of $100 plus fuel costs. *
Approved operators agree not to exceed posted weight and passenger capacities for each Watercraft. See rental rate display. *
Do not operate in less than 3 feet of water or beach the watercraft. Rocks and sand will destroy the impeller. EXAMINE THE IMPELLER CAREFULLY. *
ENTER AND EXIT LAUNCH AREA AT IDLE SPEEDS ONLY AND WITH CAUTION. *
If you have equipment malfunction or any problem with the Watercraft, RETURN IMMEDIATELY. Your time runs until you return the Watercraft. *
There are NO REFUNDS, RAIN CHECKS OR CREDIT FOR UNUSED TIME. *
THERE ARE NO REFUNDS FOR UNUSED GAS. *
HOODS CANNOT BE REPAIRED! They must be replaced. STAY CLEAR OF DOCKS and other craft that could scratch or damage your hood. *
DO NOT FLIP OVER THE WATERCRAFT! Swamping and engine damage will result. *
Security deposit is required prior to boarding and will be applied to any charges and/or repairs UP TO THE FULL VALUE OF THE CRAFT. *
I agree not to board the craft until I feel that I have been fully instructed in all operating and safety features. I further understand that I AM RESPONSIBLE FOR ANY AND ALL EQUIPMENT AND RETURN OF RENTAL. *
I understand that there are no warranties relating to the Watercraft being rented “AS IS.” *
I have read or had read to me and have fully reviewed and understand the “RULES, REGULATIONS AND INSTRUCTIONS.” *
I have read or had read to me and have fully reviewed and understand the “PWC ORIENTATION CHECKLIST ". *
I have read or had read to me and have fully reviewed and understand the WARNINGS, RISKS AND RELEASE.” *

The Security Deposit will be refunded provided there are no outstanding charges and the craft is returned at the scheduled time and place. I have read, understand and agree to all items. I authorize my credit card to be charged for any and all repairs (including theft) to the craft during the rental period or until I return the craft.

RULES, REGULATIONS AND INSTRUCTIONS



  1. 1) Approved operator is now the operator of a watercraft. Always look in all directions for other boats before turning. Look behind you often.

  2. 2) Do not splash anyone, and keep a minimum of 100 feet from any and all water vessels at all times. This is a boating law in California, Nevada, and Arizona.

  3. 3) Never beach the craft or operate in less than 3 feet of water. Rocks and debris will damage the impeller.

  4. 4) Always wear a coast guard approved personal floatation devise (PFD).

  5. 5) Securely attach the lanyard to the approved operator’s life jacket. Lanyard must be worn at all times!

  6. 6) Turns cannot be made without applying the throttle.

  7. 7) The craft is NOT DESIGNED to be capsized. If the approved operator should capsize the watercraft, swim to the rear and IMMEDIATELY upright the craft by turning it clockwise. Capsizing may cause swamping or engine damage and result in extra charges.

  8. 8) There are NO BRAKES on the personal watercraft. Stopping distance from full speed is over 300 feet. Keep a safe distance from other watercraft, beaches, swimmers, and boat docks.

  9. 9) Do not jump boat wakes or cross the path of oncoming boats. Boats on the right have the right-of-way. Stay on the right side of the river (just like driving a car). If the approved operator meets someone head-on coming from the opposite direction YIELD TO THE RIGHT.

  10. 10) If you let someone other than the approved operator drive, you are responsible for any repair or liabilities.

  11. 11) The approved operator will reimburse Laughlin River Jet Ski Rentals for all repairs to the watecraft while it is in the approved operator’s possession, including theft.

  12. 12) Do not operate the watercraft at any time while under the influence of any drugs or alcohol.

  13. 13) Do not exceed idle speeds in NO WAKE ZONES, especially in front of HARRAHS, by DAVIS DAM, and in the AVI MARINA.

  14. 14) All passengers aboard the watercraft shall follow all rules and regulations mentioned above. Laughlin River Jet Ski Rentals has the right, at any time, to cancel or return any or all guests to shore for any reason concerning safety or non-cooperation. You agree to forfeit your trip as well as all proceeds thereof to Laughlin River Jet Ski Rentals in this event. These rules are for the approved operator’s safety and the safety of all guests.

  15. 15) The approved operator is responsible for any repairs to the watercraft, including theft, up to the full amount of the value of the watercraft.

WARNINGS, RISK AND RELEASE


Defined Words in this agreement:

“I”, “me” and “my” mean the renter.

“You” and “Your” means Laughlin River Jet Ski Rentals.

“Approved Operators” and “we” mean such and all of the renters and all other approved operators who sign this agreement.

“LRJSR” means Laughlin River Jet Ski Rentals.

“This Agreement” means this Watercraft Rental Agreement, the Rules, Regulations and Instructions, the PWC Approved Operator Orientation Checklist, and all other attachments.

“Watercraft” means the watercraft described above and all attached equipment and accessories.


Agreement and Resolution: You, I and the Approved Operators agree to all of the provisions of this Agreement. I represent to you that all of the information in this Agreement is true and correct.


Rental: I agree to rent the Watercraft from you, and you agree to rent the Watercraft to me, for the rental term described on the front of this document. YouhavedeliveredtheWatercrafttome,andIhaveinspected and accepted the Watercraft in its present “AS IS” condition. Not later than the check-in time at the end of the rental term, I will return the Watercraft to you at the rental location in good clean seaworthy and undamaged condition. I will return the Watercraft with the same stores and amount of fuel on board, or I will pay you at your request for any shortages at your retail prices.


Payment: At your request, I will pay you the Rental Charge and Security Deposit described above, all charges on the Watercraft Check Out/In Sheet, and all other fees and charges under this Agreement. If I do not return the Watercraft on time, at your request, I will pay you late fees as agreed upon in the Rental Agreement.

CREDIT CARD: IF I AM CHARGING ANY PAYMENT UNDER THIS AGREEMENT TO MY CREDIT CARD, YOU MAY CHAGE MY CREDIT CARD FOR ANY OTHER AMOUNTS THAT I OWE YOU UNDER THIS AGREEMENT.


Security Deposit: I give you a security interest in the Security Deposit to secure all obligations of the Approved Operators in this Agreement. You may use the Security Deposit to pay any of the obligations in this Agreement. You will return the remaining amount of the Security Deposit, without interest, to me after you have deducted all amounts necessary to pay the obligations under this Agreement. The Security Deposit does not excuse any Approved Operator from any obligation under this Agreement.


Inspection and Repair: I have inspected the Watercraft, and the Watercraft is acceptable and suitable for the rental. I am liable for all loss and repair to the Watercraft from any cause.


Good Faith and Fair Dealing: In performing this Agreement, you and the Approved Operators will use good faith and deal fairly.


Cancellation: You may cancel the rental if:

• Any Approved Operator fails to comply with any provision of this

Agreement; or

• Any representation of Any Approved Operator is untrue; or

• The Watercraft is damaged; or

• You determine that the rental should be cancelled because of any natural

cause, medical problem, safety problem, or other problem.


If you cancel the rental, I will return the Watercraft to you, you may take possession of the Watercraft, you may enforce your other rights and remedies, and the other provisions of this Agreement will still be in effect.


Also, because of any natural cause, medical problem, safety problem, or other problem, at your request the Approved Operators will stop any activity in the use of the Watercraft, and you may refuse or terminate the participation of any person who you feel is not able or willing to properly participate in any activity in the use of the Watercraft.


The Approved Operators agree that you have the right to do this for the safety and protection of me, the Approved Operators and other persons, and for the proper use and protection of the Watercraft.


Personal Information: You may release or share any information about the Approved Operators with anyone who leases an of the Watercraft to you. This information includes but is not limited to the information in this Agreement and any driver’s licenses and insurance.


INDEMNIFICATION AND RELEASE. By agreeing this section, the Approved Operators acknowledge that they have read or had read to them the following terms and agree to them as stated.

Agree to INDEMNIFICATION AND RELEASE *

THE APPROVED OPERATORS REALIZE THAT THERE ARE CERTAIN KNOWN AND UNKNOWN HAZARDS RELATING TO THE USE OF THE WATERCRAFT. THE APPROVED OPERATORS RELEASE YOU AND ALL OF YOUR OFFICERS, ASSIGNS, EMPLOYEES AND REPRESENTATIVES FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, ACTIONS, ATTORNEYS’ FEES AND EXPENSES, FOR BODILY INJURY, DEATH OR PROPERTY LOSSES, CONNECTED WITH OR ARISING FROM THE USE OF THE WATERCRAFT, INCLUDING BUT NOT LIMITED TO AL RISKS OF ANY NATURE, KNOWN OR UNKNOWN, ANTICIPATED OR UNANTICIPATED, WITHOUT REGARD TO WHETHER THEY ARE INHERENT IN OPERATING OR RIDING ON THE WATERCRAFT. THE APPROVED OPERATORS UNDERSTAND THAT THIS IS AN UNCONDITIONAL, FULL AND COMPLETE RELEASE, WHICH INCLUDES ALL CLAIMS WHETHER CAUSED BY THE GROSS OR SIMPLE NEGLIGENCE OR THE ACTION OR INACTION OF THE PARTIES RELEASED TO THE EXTENT NOT COVERED BY YOUR INSURANCE, WE WILL DEFEND AND INDEMNIFY YOU, AND ALL OF YOUR EMPLOYEES AND AGENTS FOR ALL CLAIMS, DEMANDS, LOSSES, DAMAGES, ACTIONS, ATTORNEYS’ FEES AND EXPENSES RELATING TO THE USE OF THE WATERCRAFT. TO THE EXTENT PERMITTED BY LAW, YOU AND YOUR, OFFICERS, AGENTS AND EMPLOYEES WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL OR OTHER DAMAGES RELATING TO AN APPROVED OPERATOR’S USE OF THE WATERCRAFT.


TO THE EXTENT PERMITTED BY LAW, THE APPROVED OPERATORS ACCEPT AND ASSUME THE RISK OF PERSONAL INJURY, ACCIDENTS AND ILLNESS OF THE APPROVED OPERATORS AND OTHER PERSONS. THIS INCLUDES BUT IS NOT LIMITED TO SPRAINS, TORN MUSCLES AND LIGAMENTS, FRACTURED OR BROKEN BONES, EYE DAMAGES, CUTS, WOUNDS, SCRAPES, ABRASIONS, CONTUSIONS, BURNS, DROWNING, OXYGEN SHORTAGE, EXPOSURE, HEAD, NECK AND SPINAL INJURIES, BITE OR ATTACK BY ANIMAL OR INSECT OR MARINE LIFE, ALLERGIC REACTION, SHOCK, PARALYSIS, AND/OR DEATH.


I AM RENTING THE WATERCRAFT “AS IS.” YOU ARE NOT MAKING ANY EXPRESS OR IMPLIED WARRANTY OF THE WATERCRAFT. YOU ARE NOT LIABLE FOR ANY LOSS FROM ANY DEFECT IN THE WATERCRAFT. YOU DID NOT MANUFACTURE THE WATERCRAFT. YOU ARE NOT MAKING ANY REPRESENTATION, WARRANTY OR AGREEMENT, EXPRESS OR IMPLIED, REGARDING THE CONDITION, QUALITY OR SUITABILITY OR FITNESS OF THE WATERCRAFT. TO THE EXTENT PERMITTED BY LAW, YOU WILL NOT BE LIABLE FOR DAMAGES, INCONVENIENCE OR TIME LOST DUE TO ACCIDENT, BREAKDOWN OR MALFUNCTION OF THE WATERCRAFT.


Operation of Watercraft: Each Approved Operator represents to you and agree that:


• Each Approved Operator is at least 18 years old. Except for the

Approved Operator, no other person may operate the Watercraft.

• No one will operate the Watercraft while under the influence of alcohol

or drugs or other impairment. No one will smoke on board the

Watercraft. There will be no grilling or cooking on the Watercraft.

• Each Approved Operator will comply with all federal, state and local laws.

The Approved Operators will pay al fines relating to the use of the

Watercraft.

• Each Approved Operator will comply with all no-wake rules and all

environmental and endangered species rules.

• No more than the number of person approved by the Coast Guard and

other rules shall ride the Watercraft at any time. The weight limit for the Watercraft will not be violated. The Watercraft must be equipped with a Coast Guard certified life vest for each person aboard, and all children 14 years of age and under will wear a Coast Guard certified life vest on the Watercraft at all times.

• No one will transport the Watercraft more than 25 miles from where it is rented.

• The Watercraft will only be used for recreational purposes. The Watercraft will not be used for business or commercial purposes.

• Each Approved Operator will operate the Watercraft in accordance with all safety rules.

• Each Approved Operator is experienced and capable in all aspects of operating and towing the Watercraft.

• If there is an accident or loss, I will immediately contact the local police department, and I will give you a completed incident report.


Insurance: There is NO INSURANCE coverage being provided to protect any Approved Operator and that coverage must be obtained by the Approved Operator. LRJSR is not providing any insurance to protect any liability or the interest of any Approved Operator.

Agree there is no insurance coverage being provided *

No Transfer: I cannot transfer any of my right or interest under this Agreement. Any transfer is void.


Void Provisions: If any provisions of this Agreement are void, it will not affect the rest of this Agreement, and the rest of the Agreement remains in effect.


Waiver, Change and Termination: No provisions of this Agreement can be waived, changed or terminated, except in writing signed by you and the Approved Operators.


Court Jurisdiction and Venue: The courts located in Arizona shall have exclusive jurisdiction of any litigation related to this Agreement or the use of the Watercraft. No Approved Operator may sue LRJSR or any of LRJSR’s employees or agents in any other state.


Heirs and Representatives: This Agreement binds the parties who sign this Agreement and their heirs, representatives, successors and assigns.


Governing Law. This Agreement is governed by the internal laws of the State of Arizona.
